Federal Appeals Court Exposes Pirro’s Misconduct

“In twelve years on this Court I have never seen such a Brady violation.”

Last Tuesday, August 22nd, the United States Court of Appeals for the Second Circuit handed up a decision in the Anthony DiSimone case. The appeal was by Westchester District Attorney Janet DiFiore’s Office, as Cross-Appellee, in opposition to an earlier decision by Federal District Court Judge Charles Brieant, granting a writ of habeas corpus, on a challenge to sufficiency of evidence, which produced a conviction for Depraved Indifference Murder. The decision, which reversed the lower Court’s ruling, for “procedural insufficiency,” more importantly exposed the prosecutorial misconduct, and outright unlawful activities engaged in by former DA Jeanine Pirro, and now justified, and defended, by Janet DiFiore, her successor.

Specifically, although the main thrust of the original petition filed by DiSimone, with the Federal District Court, dealt with the sufficiency of evidence presented in connection with his conviction for Depraved Indifference Murder in the death of Louis Balancio, the real significance of the decision is its detailed exposure of the calculated, and unlawful activities engaged in by a malicious prosecutor bent on convicting an innocent Defendant, for her own purposes, at any cost. The case arises from a street brawl in front of the former Strike Zone Bar, on Central Avenue in Yonkers, in 1994, between some thirty local toughs that resulted in the death of the 21-year-old college student who suffered a total of thirteen stab wounds.

Defendant DiSimone, who continued to live in plain sight in the City of Yonkers, with his wife and infant son, became the target of one of DA Pirro’s more imaginative propaganda efforts. She would falsely claim that he had run off to Sicily, and that he was being pro tected by the Cosa Nostra. She would twice try to indict him, failing each time, while succeeding in indicting Darin Mazzarella, a known criminal charged in other homicides and present at the Strike Zone incident. Finally, only after empanelling a so-called “special grand jury” and offering immunity from prosecution, and placement into a witness protection program to Mazzarella, and his equally violent, and criminal brother Nick, in return for testimony against DiSimone,, was Mrs. Pirro able to secure an indictment against him.

The 29-page decision, authored by Justice Calabresi, the presiding judge of the three judge panel, who listened to the oral arguments offered by John R Bartels, Jr., attorney for Anthony Di-Simone, and Valerie A. Livingston, for DA Janet DiFiore, on June 21, disposes of the Defendant’s principle contention within the first half of the text concluding, “Because we find that DiSimone’s insufficiency claim was procedurally defaulted, we need not, and do not consider its merits:”

DiSimone, who was acquitted at trial of intentional murder, by a jury of his peers, was arguing that his conviction for Depraved Indifference Murder was not supported by the evidence produced at that trial, in accordance with a line of recent New York State Court of Appeals decisions in Gonzalez, Payne, and Policano, and several other cases over the past 2 ½ years. However, Sufficiency of the Evidence, although the basis of Judge Brieant’s habeas corpus grant, was not the only claim brought by DiSimone. There was the Brady violation claim, dealing with the obligation of the Prosecution to present to Defendants any, and all, information turned up by the Prosecution, which may be exculpatory to the Defendant, as well as the Confrontational Clause, the right of an Accused to confront his accusers as guaranteed by the Constitution.

Of these, the Federal Appeals tribunal was most interested in, and offended by, the particulars of DiSimone’s Brady claim. The Court, in its decision, summarized DiSimone’s Brady claim, stating, “DiSimone argues that the state violated its Brady obligation by failing to disclose, until near the close of the government’s case, information that a person other than DiSimone had asserted that he had stabbed the victim twice just before DiSimone allegedly stabbed the victim.”

This reporter was present on June 21st of this year for the oral arguments at the United States Second Circuit Court of Appeals, when Presiding Judge Calabresi made his impassioned declaration, “In twelve years on this Court I have never seen such a Brady violation.” That declaration not only set the direction the Court would be pursuing that day but, in a broader sense, it represented a harbinger of things to come, as federal and state appellate tribunals become increasingly aware of the egregious and morally bankrupt practices engaged in by the Westchester District Attorney’s Office for twelve years under the Pirro regime.

In fact, on February 10, 1994, just six days following the Balancio murder, Yonkers Police Detective Robert Molinaro had interviewed a 21-year-old Yonkers resident, Luvic Gjonaj, who provided a signed statement indicating that on February 6, 1994, his cousin, Nickoun Djonovic, had told him that he had been at the Strike Zone bar on the Thursday night of the incident, and had gotten involved in the fight, and had stabbed two people, one of whom was Louis Balancio, who he admitted stabbing twice, once in the chest. Furthermore detectives had obtained a search warrant for Djonovic’s apartment, found, and seized a bloody jacket, corroborating his confession.

However, Mrs. Pirro was not interested in this evidence because it did not fit the scheme and the profile she needed to project. Pirro saw the tragic events at the Strike Zone as an opportunity to help her shed her well-earned reputation as a prosecutor who didn’t prosecute Organized Crime. Her husband Al’s connection to it helped reinforce that reputation. She was determined to make this brawl between young street fighters into a Mafia thing. And, so naturally a murderer, even a confessed murderer, named Nickoun Djonmovic, somehow just wouldn’t fill the bill, the way someone with an Italian sounding name would.

The Court observed, “DiSimone made three separate requests for Brady material.” First in pre-trial motions in January 2000, then one week before the start of the trial, in a letter dated September 25, 2000, and finally, on October 2, 2000, just before jury selection. At no point did Mrs. Pirro’s Office turn over the Gjonaj statement, instead, moving to suppress its admission, stating, “It is the People’s position there is no link in the chain of evidence that connects Nick Djonovic to the commission of this homicide.”

Mrs. Pirro, anxious to convict someone she had maliciously and dishonestly portrayed as a member of Organized Crime, would now engage in the worst kind of prosecutorial misconduct, including subornation of perjury, to achieve her ends. And, she was not alone in her evil conspiracy. Judge James Cowhey, who, not so coincidently, dated her mother, Ester Ferris, was involved in the conspiracy to convict an innocent defendant, right up to his eyeballs, as Judge Calabresi indicates, “The trial court did not turn the statement over to the Defense until eleven days after it had received it from the Prosecution, shortly before the close of thestate’s case.”

Cowhey then refused to grant a motion by DiSimone’s attorney seeking a continuance, and time to put together a strategy, based on the new information which had been withheld. He then proceeded to reject three motions for mistrial that were based on the glaring Brady violations.

The Appeals Court decision leaves little doubt that the materials unlawfully withheld from DiSimone, “tended to support a potential Defense theory that, whatever DiSimone’as involvement in the fight, he was not the cause of Balancio’s death.” Justice Calabresi states, “Whatever else it may be, it is not murder to shoot a dead body. Man dies but once.”

He then gets tough with Janet DiFiore, who now appears to relish defending and justifying Jeanine Pirro’s outrageously unlawful prosecutorial misconduct, declaring, “ The government’s contentions to the contrary are wholly without merit.” He goes on, “In the first place, if there were questions about the reliability of the exculpatory information, it was the prerogative of the Defendant and his counsel, and not of the Prosecution, to exercise judgment in determining whether the Defendant should make use of it.”

The Court concludes that the information was favorable to the Defendant, and material, and that its late disclosure significantly influenced the outcome of the trial. The Court further notes the existence of one very small spot of blood supposedly connecting the Defendant, on a sweater that, interestingly was never proven to have belonged to DiSimone. The Court reminds that, “No witness testified to seeing the stabbing, and the murder weapon was not recovered.”

What the Court may not have known was that the Prosecution’s so-called Blood Splatter Expert was hired two days before the trial, and was paid more than $30,000 to make his assessments from photographs. Neither could the Court be aware of Mrs. Pirro’s antics. Appearing several times in the trial courtroom with the victim’s mother, and on television and in the press with her as well, all calculated to improperly persuade the jury.
Judge Calabresi declares, “We hold that there is a reasonable probability that had this material (the statement implicating Djonovic) been available the result in the case would have been quite different.”

Those who have observed the patterns and practices over twelve years in the Westchester District Attorney’s Office under Jeanine Pirro are only too well aware of the repeated outrageous prosecutorial misconduct, and outright criminal activity engaged in to achieve her despicable self-promotional agenda, The Anthony DiSimone case is but one of a long list of serious injustices perpetrated by Jeanine Pirro and a small number of misguided and selfishly motivated prosecutors whose criminal and reprehensible actions are just now slowly coming to light.
There are numerous innocent individuals, who, like Mr. DiSimone have been incarcerated for crimes they did not commit. They and their families have paid, and continue to pay, for the mistake the People of Westchester made three times when they entrusted Jeanine Pirro to be their chief law enforcement officer. Over Time, as the courts recognize the magnitude and the frequency of Mrs. Pirro’s evil, criminal deeds, underthe color of law, the taxpayers of Westchester will be burdened with the cost of compensating her victims.

The Depraved Indifference Murder Statute has been a “boondoggle,” abused and manipulated by prosecutors throughout New York State for 39 years, with the full knowledge and complicity of the state’s highest court. Not until March 2004, with the Gonzalez Decision, out of Rochester, did the Court of Appeals begin to seriously, if not wholeheartedly, come to grips with the injustices worked by ruthless prosecutors throughits nebulous and confusing language.

Some prosecutors more than others, those whose agendas were most self-promotional, such as Jeanine Pirro, and Charles Hynes, abused the statute to the level of criminality, frequently offering juries, and unwary judges, a smorgasbord selection of murder theories, Intentional, or Depraved Mind, counting on the notion that “juries love to compromise.”

Those of us who attended the oral arguments in the DiSimone case, emerged from the courthouse not quite sure of what we had witnessed, given that the principle claim involved Depraved Indifference Murder, and yet, the three justices had continued to dwell on, and ask questions, almost exclusively, about Brady violations. Later that day we got a glimpse of what was on their minds, when the Court posted information on the Policano case, and took the most unusual step, calling upon the New York State Court of Appeals for “certification” regarding the Depraved Indifference Murder Statute, and whether the rules of interpretation under which that court has been recently operating constitute “old, or new, law.”

In reality, the Federal Court was saying to the state’s highest court, “You’ve permitted this situation that unjustly, and unfairly advantages prosecutors to go on for nearly forty years. And, now, suddenly two years ago, you began dealing with it. Well, some of the residue is landing on our steps, so please give us some guidance to help us clean up your mess.”

The family and friends of a woman shot to death in her home paid their final respects to her on Friday.

About 70 people attended the morning funeral at the Church of St. Peter for Sandra Hackley-Cornielle, 37, who was slain April 21 in her apartment at 1159 Yonkers Ave. by two gunmen. Her husband, Rafael L. Cornielle, 31, who was shot in the leg and chest, attended the funeral using a cane and read the opening Bible passage.

The Rev. Joseph Espaillat, St. Peter's pastor, addressed Cornielle during his homily, urging him and his family not to succumb to feelings of vengeance or violence. He also explained to Cornielle the meaning of his first name, which Espaillat said means "God's remedy" or "God's medicine."

"You want to know why you healed so quickly? God's medicine. It's not a coincidence," Espaillat told Cornielle, alternating between English and Spanish.

The priest then told mourners that Hackley-Cornielle's name means "helper" or "defender of men."

"You yourself said, 'Father, she made me, she completes me,' " Espaillat told Cornielle. "Bro, she helped you."

After the Mass, the family took Hackley-Cornielle's body to Oakland Cemetery.

On Thursday police detectives said Hackley-Cornielle's ex-boyfriend was a "person of interest" in her slaying. The unidentified man is the father of Hackley-Cornielle's 6-year-old daughter, but police stressed that he was not a suspect and was cooperating with their investigation.


The father of Hackley-Cornielle's 12-year-old daughter is dead, authorities said. The girl, who read a poem at her mother's funeral, was grazed by a bullet but not seriously hurt.

Yonkers police have been busy this week soliciting help from the public to solve the slaying. On Wednesday night, detectives went to the woman's apartment building and spent two hours handing out more than 500 fliers in English and Spanish asking for help in the investigation.

One of the shooters is described as a Hispanic man who was dressed in tan pants and a tan jacket. He was in his 20s. Police believe he used a package to pose as a delivery man to get into the building.

The second gunman is a heavy-set black man in his 20s. He wore a dark hooded sweatshirt and dark blue jeans.

On the night of the shooting, the victims returned home at 7:30 p.m. with the two children. They were attacked inside the building. Hackley-Cornielle was shot several times. Cornielle was able to escape from their first-floor apartment and run across the street.

Police are asking anyone with information to call the Detective Division at 914-377-7725.

A felon who admitted to his role in a home-invasion robbery last year in Yonkers tried to back out of his guilty plea Friday in Westchester County Court.

"I was misrepresented," said 25-year-old Reinaldo Perez, who pleaded guilty March 16 to first-degree burglary. "I want to tell my side of the story."

Acting state Supreme Court Justice William Wetzel said there was no basis to believe that Perez' court-appointed lawyer misled him. He reminded Perez that he volunteered his guilty plea after prosecutors apprised him of his right to trial.

The judge then sentenced him as a predicate violent felon to eight years in state prison, with five years' post-release supervision. He also issued a protective order for the victims.

Perez, of Yonkers, was accused of participating in a June 30 robbery on Riverview Place. Police said he and another man, armed with handguns, entered an apartment occupied by four adults and five children.

They took two laptop computers, a telephone, two watches and a gold chain, police said. No one was hurt.

Detectives arrested Perez a short time after the robbery. The second man was never charged.

Perez served 3 1/2 years in prison earlier on a first-degree robbery conviction from the Bronx.

We believe that the city of Yonkers' attempt to collect revenue from a nonexistent admission fee at Empire City is a poor idea. This action will assuredly lead to an extended and expensive court battle between the city and its largest revenue producer, and will ultimately waste taxpayers' money.

It is apparent that the law the city is citing enabling it to collect admission taxes was superseded by the state in 1999. It would stand to reason that if the city thought it was entitled to this revenue, it would have billed for it much earlier than now.

Prior to the opening of Empire City, all parties, the state, the city and the ownership of Yonkers Raceway, collectively determined that no admission fee would be charged. This decision mirrors the policy of every other gaming facility in the country. The development moved forward on that basis with the full knowledge of all the interested parties, including the City of Yonkers.

Empire City is a great asset to our community. In the past three years, it has provided the Yonkers public schools with $60 million in direct aid over and above the state's education contribution. The city also collects significant property taxes, sales taxes and payroll taxes from this establishment. Additionally, Empire City has created 800 permanent jobs in our city.

We fully recognize that the city faces an enormously challenging fiscal deficit. We caution however that the city's ill thought out attempt will benefit the attorneys, not the taxpayers.

After 15 years of service, Board of Education President Bernadette Dunne has decided to step down.

Mayor Phil Amicone's office confirmed Thursday that Dunne, whose term expired on May 2, will be replaced by former city engineer Andrew Api on Monday.

Amicone also plans to reappoint the Rev. Gerald Sudick, whose five-year term also expired on May 2.

"I know the mayor has very strong feelings about Andy Api," said Amicone's spokesman David Simpson, who declined to give details about Api's expected appointment or Dunne's decision.

"The mayor has made a concerted effort to appoint independent-minded people to the board," Simpson said.

Simpson said that Amicone, who was out town, will make the official announcement Monday at 10 a.m.

In an e-mailed statement, Dunne thanked the mayors who appointed her, noting that "it is time now to depart."

"The Board of Education trustees are qualified and capable. The superintendent of schools is excellent, expert and innovative based on his research and data analysis," Dunne wrote.


"Throughout these years teachers, administrators, staff and parents were recognized and valued as professionals, colleagues and friends. I am most proud of the accomplishments of Yonkers students, so many of them awarded state and national recognitions."

The Board of Education will hold its annual organizational meeting on Wednesday.

Over the past five years Schumer has held countless press conferences as New York City has lost an additional 56 Million in terror funds.

New York City should not be forced to settle for less than its fair share of these security funds.

Eleven percent of port security funding does not reflect the fact that time and again New York is the prime target for terrorism in the United States.

It is alarmingly, that Chuck Schumer sat by as the city is only getting 11 percent of the total Federal Transit and Port Security Grants.

Schumer doesn’t hold the president responsible.

Instead, he said officials at Homeland Security and the U.S. Office of Management and Budget, rather than the president, when discussing the terror fund cuts.

The bottom line is, New York City continues to be the No. 1 target for terrorism in the United States and it's Chuck Schumer's job to make sure that federal anti-terror funding reflects that reality.

If Chuck Schumer was doing his job properly, then New York City would be able to get 3,000 surveillance cameras in Midtown Manhattan, if more UASI funding is appropriated to the city—something both Mayor Michael Bloomberg and NYPD Commissioner Ray Kelly have pushed for.

Dreams of attracting high-rise apartment building development to the blighted Hudson River waterfront here have run aground, hitting investors big and small.

A group of real-estate developers said last week that they were shelving plans for two 25-story towers on the Yonkers waterfront. The developers continue to look for retail tenants for a residential-and-retail district—complete with a minor-league baseball park—that is planned for nearby where the towers were to be built.

Even more distressing for the city have been the problems at Point Street Landing, a separate $900 million, mixed-use project planned for another Yonkers site once used as a movie stage.

After a series of setbacks and delays, Satellite Asset Management, a hedge-fund firm founded by former lieutenants of financier George Soros, has put the site up for sale for a fraction of what their fund loaned to the project's now-defunct developer.

"It was an important part of our puzzle," Yonkers Mayor Philip Amicone says of Point Street Landing. "It's a shame they just weren't able to hang on long enough for that to come true."

Yonkers is New York state's fourth-largest city with a population of 200,000. Located in Westchester County about a half-hour train ride from Grand Central Terminal, it fell on hard times starting after World War II when many of its industrial jobs were lost.

But in the past decade city and business leaders pushed to transform the old industrial landscape of the Hudson waterfront. In 2003 and 2008, Connecticut developer Collins Enterprises LLC completed two phases of a 560-unit residential complex called Hudson Park. Nearby, restaurateur Peter X. Kelly, who has appeared on the Food Network's "Iron Chef," opened a restaurant on a Hudson River pier.

Meanwhile, development group Struever Fidelco Cappelli LLC said last week that it's "aggressively moving forward" with a plan to build a minor-league ballpark and 600,000 square feet of retail and entertainment space. The group is hoping to sign up tenants at a shopping-center conference in Las Vegas later this month.

But the group's plan to build two 25-story residential towers on the Hudson waterfront has been shelved because of market conditions, a spokesman says. And Collins Enterprises is still seeking financing for another waterfront development in Yonkers that would have 198 units, company president Arthur Collins says.

The difficulties in revitalizing Yonkers' scenic but rundown waterfront are most evident at still another project—the polluted 15-acre Point Street Landing site just north of the downtown train station.

Yonkers developer Homes for America Holdings Inc. acquired the waterfront site in 2005 for $22 million and later borrowed about $100 million from Satellite Asset Management to prepare for a project that would include four high-rise apartment buildings.

Five years later, the environmental cleanup is still going on and Homes for America has ceased operations. Manhattan-based Satellite Asset Management has taken over the site and is now trying to sell it for $20 million—less than the price Homes for America paid.

The $900 million Point Street Landing was going to include 1,124 housing units and nearly 100,000 square feet of office and retail space, to be built on land contaminated from decades of use as a cable factory. More recently, the site was occupied by a movie stage where films such as 2001's "Zoolander" were shot.

Homes for America got its cash from a sundry slate of investors and plowed it into a handful of development projects around the country. Chuck Colby, a Palo Alto, Calif., engineer, invested $40,000 in the privately held company in 1996. He says he has largely lost hope of getting that money back.

Homes for America, also received loans from Satellite Asset Management that with interest and penalties grew to $123 million, according to Dan Hayes, a Homes for America director. Satellite took over the Yonkers property from Homes for America in December 2008, Mr. Hayes said.

Satellite's investors include pension funds such as New Jersey's plan for public employees. In January 2009, New Jersey State Investment Council Director William Clark informed the council that Satellite Fund II LP, which made the loan to Homes for America, was being liquidated and that the state's proceeds would be less than its original $100 million investment.

A spokesman for the investment council said that the state had received $61.2 million of its original investment and could get another $8.9 million more.

A Satellite spokesman declined to comment.

The site's cleanup will be complete later this year, says Paul Adler, whose company, Blackacre Partners OPS LLC, is running the operation.

Mr. Amicone, the Yonkers mayor, says he hopes a buyer comes forward to build the waterfront project as envisioned by Homes for America. "The development potential is tremendous," he said.
